Direct or indirect customs representation
In foreign trade with third countries, laws differentiate between two types of customs representation: direct and indirect. These two types of representation are used to perform the actions and formalities set forth in customs regulations for cases dealt at the customs authorities.
Direct customs representation
means the representative acts in the name and on behalf of a third party
Indirect customs representation
means the representative acts in their own name but on behalf of the importer, and is jointly and severally liable for all legal consequences of the customs procedure.

As per the new VAT law, importers are obliged to pay import tax, i.e. customs duties imposed on imports, unless the goods enjoy exemption. Should you rely on the services of an indirect customs representative, this agent will act on your behalf in the customs procedure, and pay your tax.
Don’t forget that you and your indirect customs representative are jointly and severely responsible for paying all the taxes imposed previously and deducted incorrectly by breaching Section 129 of the new VAT law. In principle, VAT on import products are imposed and collected by the customs authority as part of their customs clearance process.
Important! The agreement of representation made with you shall state in what way the customs representative will represent you. You can use this later to prove in disputes what rights you’ve given to your customs representative. It is advisable to set out in a mandate if you wish to enforce the right of tax deduction yourself or empower your customs representative to do so (if so required by the agent).
